In accordance with Section 4(3)(5) of the “GeoSphere Austria Gesetz” (GSAG), GeoSphere Austria - Federal Agency for Geology, Geophysics, Climatology, and Meteorology (hereinafter: “GeoSphere Austria”) operates the GeoSphere Austria Data Hub. The GeoSphere Austria Data Hub, a central data infrastructure with automated access, is a service for science, business, public administration, and society. The purpose of this data infrastructure is to make data from various sources available to the public.
The GeoSphere Austria Data Hub currently contains the following types of data:
The use of this data is free to any person (hereinafter referred to as “data recipient”) insofar as the terms of use of the data sets, which are explicitly visible for each data set via the metadata, and the information and disclaimers listed here, are acknowledged and complied with.
When using data available via the GeoSphere Austria Data Hub, the data recipient must name the author of this data. If the data recipient uses data created by GeoSphere Austria, they must name GeoSphere Austria as the author and rights holder in the following manner: “Data source: GeoSphere Austria - https://data.hub.geosphere.at”.
Data published in the GeoSphere Austria Data Hub must not be used for applications or publications that support or incite criminal, illegal, racist, discriminatory, defamatory, pornographic, sexist, or homophobic activities.
All information relating to and arising from the provision of data is provided without any warranty or liability claims. Uttermost care is given to the generation and provisioning of the data. Nevertheless, errors can never be ruled out entirely. GeoSphere Austria does not guarantee the accuracy, completeness, or timeliness of the data provided. Use of the data is at the risk of the data recipient. Furthermore, GeoSphere Austria is not liable for the uninterrupted availability of the data, the data services (e.g., FTPs, APIs, etc.) or the data hub. In particular, GeoSphere Austria is not liable for technical and/or maintenance-related interruptions and failures, missing and/or faulty transmissions or other technical difficulties.
Furthermore, GeoSphere Austria is not liable for any conclusions drawn from the data provided. The data recipient shall indemnify and hold GeoSphere Austria harmless against any claims by third parties.

As their content, accuracy, timeliness, completeness, and availability are beyond the control of GeoSphere Austria, no warranty/liability is assumed for them. Furthermore, GeoSphere Austria assumes no warranty/liability for the linked data and applications, in particular for their timeliness, suitability for a particular purpose, and freedom from viruses.
The use of the data is exclusively governed by Austrian law - with the exception of the conflict of laws rules. For disputes in connection with the use of data, the competent court in Vienna shall have jurisdiction.
Should parts or individual formulations of this text not, no longer or not completely comply with the applicable legal situation, the remaining parts remain unaffected in their content and validity. Instead of an invalid provision or to fill a gap, an appropriate, legally permissible regulation shall apply that comes closest to what would have been intended according to the meaning and purpose of these terms of use if the partial invalidity or gap had been known.
